Refund Policy

3.1 Scope

This refund policy applies to all services provided by modernfrontendstudio, located at Cami. Des Rafal 41A, Esporles, Illes Balears, España. By engaging our services, you acknowledge and agree to the terms outlined in this section.

3.2 Project Milestones

All projects are structured around clearly defined milestones. Each milestone is billed upon completion and approval. Refunds are evaluated based on the specific milestone stage at which a cancellation request is submitted:

  • Pre-Development Phase (Discovery & Planning): Full refund minus a 15% administrative fee if cancellation occurs before any development work has commenced.
  • Active Development Phase: Refund is calculated proportionally based on completed vs. remaining work. Work already delivered and approved is non-refundable.
  • Post-Deployment Phase: No refund is available after the final production deployment has been completed and the client has accepted the deliverables.

3.3 Service Dissatisfaction

If you are dissatisfied with the delivered work, you must submit a written complaint within 14 calendar days of the milestone delivery date. modernfrontendstudio will review the complaint and, where justified, provide a remediation plan within 7 business days. If remediation fails to meet the original specification, a partial refund proportional to the unresolved scope will be issued.

3.4 Non-Refundable Items

  • Third-party licensing fees, domain registration costs, and hosting payments made on the client's behalf.
  • Work completed and approved under a signed milestone acceptance form.
  • Custom design assets or source code that have been transferred to the client's repository.

3.5 Refund Processing

Approved refunds are processed within 14 business days to the original payment method. For bank transfers, the client is responsible for providing accurate banking details. modernfrontendstudio is not liable for refunds delayed due to incorrect client-provided banking information.

3.6 Consumer Rights

Nothing in this refund policy limits your statutory rights under Spanish consumer protection law (Ley General para la Defensa de Consumidores y Usuarios, Real Decreto Legislativo 1/2007) or the EU Consumer Rights Directive (2011/83/EU).

Section 04

Terms of Service

4.1 Acceptance of Terms

By accessing or using the services of modernfrontendstudio, located at Cami. Des Rafal 41A, Esporles, Illes Balears, España, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

4.2 Service Scope

modernfrontendstudio provides web development, design, cloud infrastructure, and digital consulting services. The specific scope, deliverables, timelines, and pricing for each engagement are defined in a mutually agreed Statement of Work (SOW) or project proposal. These terms govern the general relationship; the SOW governs the specific engagement.

4.3 Payment Terms

  • Invoices are issued upon milestone completion as defined in the project SOW.
  • Payment is due within 14 calendar days of invoice date unless otherwise specified.
  • Late payments incur a statutory interest rate of 8% per annum plus a fixed recovery fee of €40, in accordance with EU Directive 2011/7/EU on late payments in commercial transactions.
  • All prices are quoted in Euros (€) and are exclusive of VAT unless explicitly stated otherwise.
  • Work may be paused if an invoice remains unpaid for more than 21 calendar days.

4.4 Intellectual Property

Upon full payment of all outstanding invoices, all intellectual property rights for deliverables specified in the project SOW are transferred to the client. modernfrontendstudio retains the right to display completed work in portfolio presentations and case studies unless the client explicitly requests confidentiality in writing. Pre-existing frameworks, libraries, and tools used during development remain the property of modernfrontendstudio.

4.5 Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the service relationship for a period of 24 months. Confidential information includes, but is not limited to, business strategies, technical architectures, client lists, and unpublished source code.

4.6 Limitation of Liability

To the maximum extent permitted by applicable law, modernfrontendstudio's total aggregate liability under any service engagement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. modernfrontendstudio shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption.

4.7 Force Majeure

Neither party shall be liable for failure to perform its obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, government action, internet infrastructure failures, or power outages. The affected party must notify the other within 48 hours of the force majeure event.

4.8 Termination

Either party may terminate a service engagement with 14 calendar days' written notice. Upon termination, the client shall pay for all work completed up to the termination date. All deliverables completed and paid for will be transferred to the client within 7 business days of final payment.

4.9 Governing Law

These terms are governed by the laws of España and the European Union. Any disputes arising from or related to these terms shall be submitted to the exclusive jurisdiction of the courts of Illes Balears, España. The parties agree to attempt amicable resolution before initiating formal legal proceedings.

4.10 Amendments

modernfrontendstudio reserves the right to update these terms at any time. Material changes will be communicated via email or a prominent notice on the website at least 14 calendar days before taking effect. Continued use of our services after the effective date constitutes acceptance of the updated terms.
